The International Committee of the Red Cross is conducting a study of legal issues linked to detention, and specifically the separated regime, in Northern Ireland.

Legal Framework of Detention in Northern Ireland
- Introduction The International Committee of the Red Cross (ICRC) is conducting a study of legal issues linked to detention, and specifically the separated regime, in Northern Ireland.
2. Research
The ICRC has identified the legal framework of detention as an area that it would like to explore further. It therefore wishes to commission work, in the form of a report, from a legal practitioner, focussed on the following:
- The Good Friday Agreement framework and conditions for sentencing for crimes pre-1998
- An outline of the decision-making process and procedure for licence revocation
- Implementation of anti-terror legislation
- Clarity regarding transfers to separated regimes
- Role of intelligence evidence and access to such information
- An exploration of the legislation surrounding restrictions on released detainees
- Role of the courts including the operation of the courts (Diplock non-jury courts) and the use of judicial review to challenge decisions on detention conditions/parole and bail restrictions
This work should map key entities, legal references, and provide analysis and conclusions along with emerging themes. The work will be primarily desk-based, located at ICRC’s Belfast Office, though relevant interlocutors may also be approached, bearing in mind ICRC's preferred modus operandi of confidentiality.
3. Administrative arrangements
Relevant information should be delivered in a report to be produced within three calendar months.

An agreed fee will be paid on receipt of a satisfactory report and the submission of an invoice.
